Wedding Photography – Terms of Service

Welcome to David Zufall Photography. By booking wedding photography services, you agree to the following terms and conditions:
1. Description of Services
David Zufall Photography provides professional wedding photography services as outlined in individual service agreements. Details regarding packages, pricing, coverage hours, and deliverables will be confirmed in writing at the time of booking.
2. Payment Terms
A non-refundable $200 deposit is required to secure your wedding date. The remaining balance is due within the timeframe stated in your signed photography agreement.
Accepted payment methods: Cash, check, and Venmo.
3. Delivery of Services
Final wedding images will be delivered via a private online gallery within the agreed-upon delivery window outlined in your contract. Galleries will remain active for 30 days after delivery. David Zufall Photography will retain client files for 1 month after final delivery, after which they may be permanently deleted.
4. Coverage Time Policy
Photography services will be provided for the duration specified in the selected wedding package. Coverage will begin and end at the agreed-upon times stated in the signed contract.
Any additional time requested beyond the contracted hours will be subject to availability and billed at a rate of $200 per hour, payable prior to the start of extended coverage.
It is the client’s responsibility to ensure their event schedule fits within the contracted coverage time.
5. Location Change Policy
Once wedding photography services are booked and event locations are confirmed, any changes to ceremony or reception locations must be communicated to David Zufall Photography no later than 30 days before the event date.
Location changes requested within 30 days of the wedding are subject to availability and may incur additional travel fees or scheduling limitations. David Zufall Photography reserves the right to decline location changes made within this timeframe if they conflict with prior commitments or logistical constraints.
6. Exclusive Photographer Policy
David Zufall Photography will be the exclusive contracted professional photographer for the event. No other professional, semi-professional, or freelance photographers are permitted to provide photography services during the wedding day without prior written consent from David Zufall Photography.
This policy ensures consistent image quality, coverage, and workflow throughout the event.
7. Meal Provision
The client agrees to arrange for a meal to be provided for David Zufall during the reception if coverage extends through the dinner hour. This meal should be served alongside guest meals to ensure continuous coverage of important moments.
8. Limitations of Coverage
While every effort will be made to capture all requested images, David Zufall Photography cannot guarantee the inclusion of any specific moment, pose, or person due to the candid, live nature of wedding events. Coverage may be affected by venue restrictions, lighting conditions, weather, guest cooperation, or scheduling delays.
9. Photographer Cancellation or Emergency
In the rare event that David Zufall is unable to fulfill photography services due to serious illness, accident, or an unforeseen emergency, every effort will be made to provide a qualified replacement photographer. If no replacement is available, all payments received, including any retainer, will be refunded in full.
10. Model Release and Image Use
By booking services, clients grant David Zufall Photography permission to use images from the wedding for marketing, portfolio, website, social media, and promotional purposes. Clients may submit a written request for specific images to be excluded from public use.
11. Copyright and Usage Rights
David Zufall Photography retains the copyright to all images produced. Clients are granted personal rights to print, share, and distribute images for non-commercial, personal use only. Images may not be sold, altered, or used commercially without written permission.
12. Client Responsibilities
Clients are responsible for securing any necessary photography permissions for all event locations. Clients must also notify David Zufall Photography in advance of any guests or participants who do not wish to be photographed. While every effort will be made to honor such requests, no guarantees can be made for complete exclusion.
13. Liability
David Zufall Photography is not liable for circumstances beyond control, including equipment failure, adverse weather, venue restrictions, or other unforeseen issues. Reasonable precautions will be taken to protect digital files and equipment.
In the event of unavoidable cancellation by the photographer, all payments made will be refunded.
14. Governing Law
These terms are governed by the laws of the State of New York. Any disputes will be resolved through the courts of St. Lawrence County.
By booking wedding services, clients acknowledge they have read, understood, and agreed to these Terms of Service.
